Acceptable Use Policy
This Acceptable Use Policy (“Policy”) is part of AVA Golf™‘s legal framework and is incorporated by reference into the AVA Golf™ Terms of Service and Privacy Policy. By accessing or using the Services, you agree to comply with this Policy in addition to those documents.
This Policy sets out the rules governing acceptable conduct on the AVA Golf™ platform — including use of the web application, mobile applications, data integrations, video content, machine learning features, and any other services made available by AVA Golf, Inc. (“AVA Golf™,” “we,” “us,” or “our”).
AVA Golf, Inc is a wholly-owned subsidiary of ParOne, Inc.
Violations of this Policy may result in suspension or permanent termination of your account, referral to law enforcement, and civil or criminal liability. AVA Golf™ reserves the right to investigate any suspected violation and take appropriate action in its sole discretion.

1. General Use
When you use the Services, you agree that you will:
- Use the Services only for lawful purposes and in accordance with these Terms, this Policy, and all applicable local, state, national, and international laws and regulations;
- Provide accurate, current, and complete information when creating and maintaining your account;
- Use the Services only for your personal, non-commercial golf improvement purposes unless expressly authorized otherwise in writing by AVA Golf™;
- Respect the rights and interests of AVA Golf™, its data partners (including Garmin, Arccos, and the USGA), and other users of the Services.
You acknowledge that AVA Golf™‘s Services depend on accurate, authorized data flows from multiple sources, and that misuse of the platform undermines the integrity of those systems for all users.
2. Account Conduct
You are solely responsible for all activity that occurs under your account. You agree that you will not:
- Create an account using false, misleading, or fraudulent information;
- Create more than one account for the same individual without AVA Golf™‘s prior written consent;
- Share your account credentials with any person other than as permitted under the Shared Access provisions of the Terms of Service;
- Allow any third party to access the Services under your account for commercial purposes;
- Attempt to access another user’s account without authorization;
- Sell, transfer, or assign your account or subscription to any other person or entity;
- Attempt to circumvent any account verification, age verification, or authentication process;
- Use the account of another user at any time, with or without their permission.
3. Golf Data and Integrations
AVA Golf™ integrates with third-party data platforms including Garmin, Arccos Golf, and the USGA World Handicap System. Use of these integrations is subject to each partner’s own terms of service in addition to this Policy. You agree that you will not:
- Connect a third-party data account to AVA Golf™ that you are not authorized to use;
- Misrepresent your identity or authorization when connecting any Data Partner account;
- Attempt to access, extract, or aggregate another golfer’s data through the Services without their explicit consent;
- Manipulate, falsify, or deliberately corrupt any golf performance data submitted to or through the Services, including scores, shot data, handicap information, or launch monitor data;
- Post false or fabricated scores to the USGA World Handicap System through AVA Golf™‘s score posting feature;
- Attempt to artificially inflate, deflate, or manipulate your Handicap Index or the Handicap Index of any other golfer through use of the Services;
- Use data received through any integration for any purpose other than your own personal golf improvement within the Services;
- Attempt to extract, scrape, or aggregate data from Data Partner systems beyond what is made available to you through AVA Golf™‘s authorized integration;
- Use the Services to circumvent any restrictions imposed by Garmin, Arccos, the USGA, or any other Data Partner on the use of their data or platforms.
Misuse of handicap data in particular may violate USGA Rules of Handicapping and could constitute fraud in certain contexts. AVA Golf™ reserves the right to report suspected handicap fraud to the USGA or relevant golf authorities.
4. Video Content
AVA Golf™ provides a library of instructional video content matched to your performance profile through AVA Golf™‘s proprietary recommendation engine. This content is licensed for personal viewing within the Services only. You agree that you will not:
- Download, record, screen-capture, or otherwise extract any video content from the Services by any means;
- Stream, broadcast, transmit, or publicly display any video content outside of the Services;
- Share, redistribute, resell, or sublicense any video content to any third party;
- Use any video content for commercial purposes, including without limitation for paid instruction, commercial coaching, or revenue-generating activities;
- Circumvent, disable, or attempt to bypass any digital rights management (DRM), access controls, or technical protections applied to video content;
- Remove, obscure, or alter any watermarks, copyright notices, attribution markers, or other proprietary identifiers embedded in or displayed alongside video content;
- Upload AVA Golf™ video content to any third-party platform, including social media, video hosting sites, or streaming services;
- Use video content in connection with any competing product, service, or platform.
5. Machine Learning and Recommendation Systems
AVA Golf™ uses proprietary machine learning models to analyze your golf performance data and recommend instructional video content. These systems are core intellectual property of AVA Golf™. You agree that you will not:
- Attempt to reverse engineer, probe, or extract the logic, weights, parameters, or structure of AVA Golf™‘s recommendation models or analytical frameworks by any means, including through systematic querying, input manipulation, or output analysis;
- Deliberately submit false, fabricated, or manipulated data to the Services with the intent of distorting, gaming, or circumventing AVA Golf™‘s analytical or recommendation outputs;
- Attempt to infer proprietary analytical methodologies, scoring systems, or recommendation logic through pattern analysis of outputs;
- Use outputs from AVA Golf™‘s machine learning systems to train, validate, or develop competing AI or machine learning models;
- Exploit any error, bias, or unintended behavior in AVA Golf™‘s systems in a way that harms other users, AVA Golf™, or its data partners;
- Use AVA Golf™‘s analytical outputs to benchmark or evaluate competing golf performance products or services.
6. CSV Imports and Third-Party Data
The Services allow you to import golf performance data via CSV file upload from launch monitor devices and other third-party sources. You agree that you will not:
- Upload CSV data that you do not have the legal right to use, share, or submit to AVA Golf™;
- Upload data belonging to another individual without their explicit consent;
- Upload falsified, fabricated, or deliberately corrupted performance data;
- Upload data obtained in violation of any third party’s terms of service or intellectual property rights;
- Use CSV imports to circumvent or supplement a data partner integration in a manner not authorized by AVA Golf™ or the relevant data partner;
- Upload malicious files, executable code, malware, or any content designed to harm AVA Golf™‘s systems or users.
You are solely responsible for ensuring that any data you import is accurate, lawfully obtained, and that your upload does not violate any third-party rights or agreements.
7. Shared Access and Authorized Users
The Services allow you to authorize specific individuals — such as a golf coach or family member — to access your AVA Golf™ profile and data (“Authorized Users”). You agree that you will not:
- Grant Authorized User access to any individual without their knowledge and consent;
- Use the Authorized User feature to provide commercial golf coaching or instruction services under a consumer subscription;
- Grant Authorized User access to competitors, data aggregators, or any party that intends to use your data for purposes beyond your personal golf improvement;
- Allow an Authorized User to make changes to your account settings, subscription, or payment information without your authorization;
- Use another user’s Authorized User access to access the Services beyond the scope of what that user has authorized.
8. Prohibited Technical Conduct
You agree that you will not engage in any of the following with respect to the Services:
Unauthorized access and system interference:
- Attempt to gain unauthorized access to any part of the Services, AVA Golf™‘s infrastructure, servers, databases, or connected systems;
- Probe, scan, or test the vulnerability of the Services or any related system or network;
- Attempt to circumvent, disable, or interfere with any security feature, authentication mechanism, or access control;
- Access the Services through any means other than the interfaces expressly provided by AVA Golf™.
Automated and programmatic misuse:
- Use bots, scrapers, crawlers, spiders, scripts, or any automated tool to access, query, extract, or monitor the Services or any data therein, except as expressly authorized by AVA Golf™ in writing;
- Use any data mining, data harvesting, or data extraction tool on the Services;
- Automate any interaction with the Services that a human user would normally perform manually, including account creation, data submission, or integration connections;
- Access AVA Golf™‘s APIs or backend systems without a separate written API license agreement with AVA Golf™.
Harmful technical actions:
- Upload, submit, or transmit any virus, Trojan horse, worm, ransomware, spyware, adware, or other malicious code or software;
- Introduce any material that acts as a passive or active data collection mechanism, including tracking pixels, web bugs, or similar devices;
- Take any action that imposes an unreasonable or disproportionate load on AVA Golf™‘s infrastructure;
- Interfere with, disrupt, or degrade the performance of the Services for other users;
- Attempt to intercept, monitor, or capture any data transmitted through the Services that is not intended for you;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any component of the Services.
9. Prohibited Commercial Conduct
The Services are provided for personal, non-commercial use only under a standard consumer subscription. You agree that you will not:
- Use the Services or any AVA Golf™ Content to develop, operate, or improve a competing product or service;
- Resell, sublicense, or otherwise commercialize access to the Services or any AVA Golf™ Content;
- Use AVA Golf™‘s coaching outputs, performance analyses, or video content in a commercial coaching or instruction context without a separate written agreement with AVA Golf™;
- Use AVA Golf™‘s platform to solicit other users for commercial services;
- Use the Services to conduct market research or competitive intelligence on behalf of a third party;
- Access the Services on behalf of a competitor for any purpose;
- Use aggregated or extracted data from the Services for any commercial data product, report, or service.
10. Intellectual Property
You agree to respect the intellectual property rights of AVA Golf™ and all third parties in connection with your use of the Services. You agree that you will not:
- Copy, reproduce, modify, distribute, or create derivative works of any AVA Golf™ Content without prior written permission from AVA Golf™;
- Remove, obscure, or alter any copyright notice, trademark, watermark, or other proprietary marking on any AVA Golf™ Content;
- Use AVA Golf™‘s name, logo, trademarks, or brand elements — including the word mark “AVA Golf™,” the AVA Golf™ logo, or the AVA Golf™ stylized wordmark (each subject to pending USPTO trademark registration) — without prior written permission from AVA Golf™;
- Claim ownership of, or assert any intellectual property rights in, any AVA Golf™ Content or any outputs generated by AVA Golf™‘s analytical or recommendation systems;
- Use any content licensed from Garmin, Arccos, the USGA, or any other Data Partner in a manner that exceeds the scope of your authorized access through the Services;
- Submit User Content that infringes, misappropriates, or violates the intellectual property or other rights of any third party.
11. Communications and Community Conduct
To the extent the Services include any communication features — including support channels, feedback tools, or future community features — you agree that you will not use such features to:
- Harass, threaten, intimidate, abuse, or harm any other user, AVA Golf™ employee, or third party;
- Submit false, misleading, or defamatory information about AVA Golf™, its partners, its employees, or other users;
- Submit false or abusive support requests or abuse reports;
- Impersonate any person or entity, including AVA Golf™ staff, Data Partners, or other users;
- Transmit unsolicited commercial communications (spam) to other users or to AVA Golf™;
- Post or transmit content that is unlawful, obscene, hateful, discriminatory, or otherwise objectionable;
- Attempt to obtain sensitive information — including passwords, payment details, or personal data — from other users through any means.
12. Consequences of Violation
AVA Golf™ takes violations of this Policy seriously. Depending on the nature, severity, and frequency of the violation, AVA Golf™ may take one or more of the following actions at its sole discretion:
Warning: For minor or first-time violations, AVA Golf™ may issue a formal written warning requiring the user to immediately cease the violating conduct.
Temporary Suspension: For repeated or more serious violations, AVA Golf™ may temporarily suspend your access to some or all of the Services while the matter is investigated. Suspended accounts remain subject to the monthly Subscription Fee during the suspension period unless AVA Golf™ determines otherwise.
Permanent Termination: Serious violations — including fraudulent conduct, data manipulation, IP infringement, unauthorized system access, or conduct that harms other users or AVA Golf™‘s data partners — may result in permanent termination of your account without refund.
Referral to Data Partners: Where a violation involves misuse of data received from Garmin, Arccos, the USGA, or another Data Partner, AVA Golf™ may notify the relevant Data Partner of the violation and cooperate with any investigation they conduct.
Legal Action: Where violations cause harm to AVA Golf™, its data partners, or other users, AVA Golf™ reserves the right to pursue all available civil and criminal remedies, including seeking injunctive relief, damages, and attorneys’ fees. AVA Golf™ may report violations to law enforcement or regulatory authorities where appropriate.
Referral to Golf Authorities: Where a violation involves manipulation of handicap data or other conduct that implicates the integrity of the game of golf, AVA Golf™ may report the matter to the USGA, relevant regional golf associations, or other golf governing bodies.
Termination of your account for violation of this Policy does not entitle you to any refund of subscription fees paid.
13. Reporting Violations
If you become aware of any conduct by another user or third party that you believe violates this Policy, please report it to AVA Golf™ at:

Please include as much detail as possible, including the nature of the violation, the platform or feature involved, and any relevant dates or account information.
AVA Golf™ will review all reports and take appropriate action in its sole discretion. AVA Golf™ does not guarantee a specific outcome or response time for violation reports, and is not obligated to disclose the actions taken in response to any report.
Policy Updates
AVA Golf™ reserves the right to update or modify this Policy at any time. We will provide notice of material changes by updating the “Last Updated” date above and, where appropriate, by notifying you via email or through the Services. Your continued use of the Services after any update constitutes acceptance of the revised Policy.
This Acceptable Use Policy is effective as of the Last Updated date above and is incorporated into AVA Golf™‘s Terms of Service.
